Terms of service.

These terms govern your use of OAKMONT. By creating an account or commissioning work, you agree to them. Enterprise customers may sign a separate master agreement.

The service

  • OAKMONT builds, edits and remediates websites and documents, and provides related managed support.
  • We quote a price before significant work begins; you approve before we proceed.

Who you contract with

  • Your agreement is with Oakmont Technologies LLC, 5511 Parkcrest Dr. Suite 103, Austin, TX 78731, USA.
  • These terms are governed by the laws of the State of Texas.
  • Disputes are resolved by binding individual arbitration in Austin, Texas; both sides waive jury trial and class actions. Claims that qualify may go to small claims court instead.
  • Mandatory consumer protections of your country of residence stay unaffected. If you are a consumer in the EU, you keep the right to bring proceedings before the courts of your place of residence.

Zero-finding guarantee

  • Every deliverable is checked before it reaches you, and a passing run is signed with the checks that ran, the checks that could not, and a hash of the exact bytes delivered.
  • If one of those checks fails on what we delivered, and you tell us within 30 days of delivery, we correct it at our cost. No fee, no argument about scope.
  • The guarantee covers the checks named in the attestation on that deliverable. It does not cover changes made to the work after delivery, content supplied by you that we were asked not to alter, or a claim that a site as a whole meets a legal standard, which is something we never state.

Your account

  • You are responsible for the accuracy of your details and for keeping your credentials secure.
  • You must have the rights to any content you submit for us to work on.

Deliverables & acceptance

  • We verify accessibility and quality before delivery. You may review, request changes, or approve.
  • On full payment, you receive a license to use the deliverables for your business.
  • Accessibility conformance is assessed against the stated standard at the time of delivery; later content changes you make are outside that assessment.
  • Until full payment, deliverables remain our property; our tooling, know-how and generic components remain ours in every case.
  • You grant us a license to use your briefs, the work and your edits to improve the service and train our internal models; nothing identifying you is shared.

Compliance outcomes

  • Accessibility and compliance work improves conformance; it does not and cannot guarantee that no complaint, claim or regulatory action will ever be brought.
  • Responsibility for a site's ongoing legal compliance stays with the site owner.

Payment

  • Per-project work is billed on the agreed price; subscriptions renew until cancelled.
  • Payments are processed by Stripe. Taxes may apply based on your location.

Refunds

  • If delivered work is defective or was not delivered, contact us within 14 days of delivery.
  • Refunds can be full or partial and go back to the original payment method via Stripe.
  • Subscriptions can be cancelled at any time and end at the close of the paid period.

SLA & service credits

  • Paid support tiers carry response time targets.
  • When we miss them, you receive service credits applied against future invoices.
  • Credits are the sole and exclusive remedy for missed response targets.

Acceptable use

  • Lawful content only.
  • Do not overload or automate the free tools beyond their rate limits.
  • Only scan sites you own or are authorized to test.
  • Reselling the service requires a partner agreement.

Free tools

  • The free scanner and health check are informational and provided as-is.
  • Their results are not a conformance certification and not legal advice.
  • You use free-tool results at your own risk; we accept no liability for decisions based on them.

How the work is made

  • Production is AI-assisted with human review before delivery; the quality bar you are promised does not depend on the tooling.
  • A partner program exists and is governed by the partner dashboard terms and any signed partner agreement.

Suspension & termination

  • We may suspend or terminate an account for violating these terms or acceptable use, or for non-payment, with notice where practicable.
  • You can stop using the service at any time; already-paid periods follow the Refunds section.

Indemnity

  • You will defend and indemnify us against claims arising from your content, your sites, material you submit, or your use of deliverables in violation of law, including intellectual property claims.

Warranties & liability

  • The service and all deliverables are provided as is; to the extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
  • To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, lost profits, lost data or business interruption.
  • Our total liability is capped at the amounts you paid us in the 12 months before the claim.
  • Nothing here excludes liability that cannot be excluded by law.

Changes & force majeure

  • We may update these terms; we announce changes, and continued use after the effective date means acceptance.
  • Neither side is liable for delay caused by events beyond reasonable control; obligations resume when the event ends.

Text messages (SMS)

  • Program: OAKMONT customer messages. If you ask us to call you back or to contact you about a request, we may text you about that request. If a Care customer lists you as a family contact, we text you when a daily call goes unanswered or something is flagged.
  • Message frequency varies: a call-back request usually means a few messages, and Care alerts are sent only when something needs your attention.
  • Message and data rates may apply.
  • Reply STOP at any time to cancel. You will receive one message confirming it and no more after that. Reply HELP for help, or reach us at admin@oakmonttechnologies.com or +1 562-991-3755.
  • Carriers are not liable for delayed or undelivered messages.
  • Agreeing to receive texts is not a condition of any purchase. How we handle your number is described in our Privacy Policy, under Text messages (SMS).
